Kelly M. Otis

Kelly joined Blanco Tackabery in 2014 after practicing with another Winston-Salem law firm for 12 years where she headed the firm’s real estate practice. Kelly’s practice focuses primarily on counseling clients in connection with commercial real estate transactions and the development of multifamily housing projects financed with federal low-income housing tax credits and other financing sources.

Kelly has substantial experience assisting purchasers, sellers and developers with the acquisition, development, financing, sale and lease of commercial real estate, including the drafting and negotiation of contracts, leases and loan documents, assistance with due diligence, and drafting of reciprocal easement agreements, covenants, escrow agreements and other closing documents. She performs complex title searches and counsels clients on title issues and defects, as well as development issues related to multifamily affordable housing projects.  She frequently serves as local counsel for out-of-state clients and attorneys who require the services of North Carolina counsel, both in connection with title work and local counsel opinions.  In addition, Kelly represents financial institutions on the documentation, negotiation and closing of commercial real estate secured loans, construction loans, and loan modifications.

 

  • Representation of developers in the acquisition and development of multifamily housing projects financed by combining federal low-income housing tax credits with other financing sources
  • Representation of national data center developer in the purchase, development, leasing and management of multiple data centers from single user build-to-suit facilities to multi-tenant data centers
  • Representation of developer of a mixed-use development of medical, office, and retail space in a primary retail corridor in land acquisition, financing, and drafting and negotiation of reciprocal easement agreements and covenants, conditions and restrictions
  • Representation of regional financial institution on real estate acquisition, development and construction loans for commercial facilities
  • Representation of commercial landlords and tenants in lease negotiations
  • Serving as local counsel to out-of-state clients and attorneys who require the services of North Carolina counsel in connection with title review and negotiation; drafting, negotiating, reviewing and analyzing documents in accordance with North Carolina law; and issuance of North Carolina opinions.
