Intellectual Property Services from Blanco Tackabery
Intellectual Property Litigation
The intellectual property law services we provide include:
Trademark Selection, Clearance and Registration
Our attorneys provide initial counseling regarding selection and clearance of trade and services marks and handle all aspects of registration in the United States, as well as coordinating registrations around the world through our relationships with dedicated foreign counsel. We also craft coexistence agreements or licenses with third parties, evaluate potentially infringing marks, and send or respond to cease and desist letters when necessary.
Copyright Registration and Enforcement
We counsel companies on all aspects of copyright creation and enforcement. We represent authors on preparing, publishing and registering original and derivative works. We also draft, negotiate and advise on agreements concerning copyrightable subject matter, including permissions and releases, employment and independent contractor agreement provisions and assignments of rights.
Trade Dress and Trade Secret Protection
Our attorneys assist our clients in identifying information that may be protectable as a trade secret and provide advice on how to keep trade secret information protected. We help our clients proactively safeguard trade secrets by crafting and reviewing confidentiality and non-disclosure agreements with individuals and other companies and provide recommendations on how to keep trade secret and confidential information confidential. Because we are a full-service firm, our intellectual property attorneys work with our employment attorneys to draft employment and independent contractor agreement provisions that ensure the protection of corporate-owned trade secrets.
Intellectual Property Portfolio Development
Blanco Tackabery assists clients in selecting and skillfully leveraging intellectual property assets that have the potential to increase the client’s profile, and when possible, reduce the potential for competitors to enter the client’s market space. We also help our clients develop and manage licensing programs and enforce or amend terms to ensure that they realize the full potential of their business relationships.
Intellectual Property in Corporate and Financial Transactions
Our attorneys assist our clients in the context of purchases and sales of intellectual property assets, securitization of intellectual property in financing and joint venture or joint development arrangements. We also assist with intellectual property valuation and status assessments, patent, copyright, trademark and trade dress infringement disputes.
Copyright, Patent and Trademark Disputes and Litigation
Our attorneys advise clients involved in intellectual property disputes regarding the potential for success, potential harm to goodwill, the likelihood of future litigation, relevant risks or benefits, and costs.
If an out of court solution is not possible, Blanco Tackabery’s attorneys are skilled at courtroom presentation and use an appropriate mix of witnesses, exhibits, video, and other courtroom technology to maximize our clients‘ ability to present their case. We are familiar with the judges, procedures and requirements in the United States District Courts of the Middle, Western and Eastern Districts of North Carolina. We represent clients as lead counsel in trademark and copyright matters and often serve as local counsel in patent litigation. Our attorneys also litigate trademark oppositions and cancellation proceedings before the Trademark Trial and Appeal Board.
Internet, Social Media and Entertainment
Images and text appearing on the Internet can be copied and used fairly easily – but the ability to copy does not make the act of copying legal. Material appearing on the Internet is entitled to copyright protection and some content may also be protected by trade or service marks. Blanco Tackabery counsels clients regarding infringing activity on the Internet, including social media pages, by helping clients enforce their intellectual property rights. We also counsel clients on how to avoid infringing the rights of others in cyberspace, including sending and responding to “take-down” letters under the Digital Millennium Copyright Act.
Our attorneys also counsel clients with regard to issues relating to film and television projects, publishing agreements, music and content licensing and sponsorship agreements. We vigorously represent clients in disputes that involve the protection of an artist’s intellectual property rights.
