Our attorneys provide initial counseling regarding selection and clearance of trade and services marks and handle all aspects of registration in the United States, as well as coordinating registrations around the world through our relationships with dedicated foreign counsel. We also craft coexistence agreements or licenses with third parties, evaluate potentially infringing marks, and send or respond to cease and desist letters when necessary.
We counsel companies on all aspects of copyright creation and enforcement. We represent authors on preparing, publishing and registering original and derivative works. We also draft, negotiate and advise on agreements concerning copyrightable subject matter, including permissions and releases, employment and independent contractor agreement provisions and assignments of rights.
Our attorneys assist our clients in identifying information that may be protectable as a trade secret and provide advice on how to keep trade secret information protected. We help our clients proactively safeguard trade secrets by crafting and reviewing confidentiality and non-disclosure agreements with individuals and other companies and provide recommendations on how to keep trade secret and confidential information confidential. Because we are a full-service firm, our intellectual property attorneys work with our employment attorneys to draft employment and independent contractor agreement provisions that ensure the protection of corporate-owned trade secrets.

If an out of court solution is not possible, Blanco Tackabery’s attorneys are skilled at courtroom presentation and use an appropriate mix of witnesses, exhibits, video, and other courtroom technology to maximize our clients‘ ability to present their case. We are familiar with the judges, procedures and requirements in the United States District Courts of the Middle, Western and Eastern Districts of North Carolina. We represent clients as lead counsel in trademark and copyright matters and often serve as local counsel in patent litigation. Our attorneys also litigate trademark oppositions and cancellation proceedings before the Trademark Trial and Appeal Board.

Material appearing on the Internet is entitled to copyright protection and some content may also be protected by trade or service marks. Blanco Tackabery counsels clients regarding infringing activity on the Internet, including social media pages, by helping clients enforce their intellectual property rights. We also counsel clients on how to avoid infringing the rights of others in cyberspace, including sending and responding to “take-down” letters under the Digital Millennium Copyright Act.
