Our litigators handle a variety of business disputes and focus on complex matters in federal courts and state courts including the N.C. Business Court. We have extensive experience litigating claims for breach of contract as well as claims such as breach of implied covenant of good faith and fair dealing, breach of express warranty, breach of implied warranty of merchantability, and breach of warranty of fitness for a particular purpose. We also have extensive experience with “business torts” including fraud, negligent misrepresentation, unfair and deceptive trade practices, breach of fiduciary duty, constructive fraud, misappropriation of trade secrets, tortious interference with contract, tortious interference with prospective advantage and defamation (libel and slander). In addition, we handle complex corporate disputes including minority shareholder oppression and shareholder derivative claims, corporate dissolutions and other “business divorce” issues. We have obtained major financial awards for clients and have successfully defended clients against substantial financial demands. We are also experienced with claims for injunctions, accountings and other non-monetary relief. From drafting pleadings to engaging in complex discovery and providing representation at trial, our experienced team is ready to guide your company through all necessary steps of litigation and advise you on whether to settle a claim or seek a final resolution through the court system. Providing cost-efficient services and real value to our clients is paramount to our Litigation Practice Group, which is willing to work on an hourly rate basis or discuss alternative fee structures in appropriate cases.
We regularly handle real property disputes including lease disputes, partitions, disputes regarding real estate purchase contracts and option contracts, boundary and easement disputes, land condemnation matters, disputes involving zoning and special use permits, disputes about title to land, disputes relating to restrictive covenants and homeowners associations, and nuisance cases. We have substantial experience representing shopping centers and other commercial landlords regarding collections, ejectments and other landlord-tenant issues. However, we represent both landlords and tenants and also have experience in high-importance residential lease disputes, including disputes involving affordable housing issues. Blanco Tackabery’s litigators have the ability to consult with a deep bench of real estate transactional attorneys within the Firm, when needed, and can leverage the extensive knowledge of real estate law that the Firm possesses.
We assist employers in defending EEOC charges, unemployment claims, and discrimination and retaliation claims in state and federal court. We review and assist in the improvement of employee handbooks, employment agreements, and severance agreements, to anticipate and avoid litigation later.
We also handle claims for breach of non-competition agreements, non-solicitation agreements and non-disclosure agreements.
We represent banks and credit unions in a variety of disputes, including customer disputes regarding alleged negligence, fraud or unauthorized transactions. We regularly assist financial institutions and other lenders in collection litigation and “claim and delivery” proceedings to recover property.
Our attorneys regularly represent clients in mediation, arbitration and other alternative dispute resolution contexts. In addition, we have attorneys who are available to serve as a mediator or arbitrator. Our arbitration experience includes representing parties in proceedings before American Arbitration Association panels and other private arbitrators. We have successfully represented parties in arbitrations in contexts ranging from construction disputes to corporate shareholder disputes.
We represent clients in a variety of cases involving trusts and estates, including trust litigation, will contests, and estate disputes. We have extensive experience with “caveat” cases in which wills have been challenged on grounds such as lack of testamentary capacity, fraud, undue influence or coercion. We have also handled cases about modifying or terminating trusts.
We represent owners, contractors and subcontractors in connection with construction disputes involving workmanship, delays, non-payment and other issues. We represent clients in connection with pre-litigation disputes and claims of lien as well as in litigation and arbitration.
We assist clients in litigation and other proceedings relating to trademarks, copyrights, and trade secrets. In addition to serving as lead counsel on various intellectual property disputes, we have served as North Carolina “local counsel” to a variety of out-of-state law firms and their clients who engage in litigation in North Carolina.
Our litigators represent insurance policyholders with respect to insurance claims and coverage disputes. We have experience with various types of insurance, including commercial general liability, homeowners, life, health, automobile, directors and officers liability, and professional malpractice.
Our litigators have significant experience with serious personal injury cases, including motor vehicle negligence cases and wrongful death cases. We have the skills to settle a case, or take it to trial, depending on our client’s needs. We can represent clients to recover money for medical expenses, lost wages, pain and suffering, loss of consortium and other damages and are familiar with handling claims involving uninsured or underinsured motorist coverage (UM/UIM).
In addition to possessing extensive experience in all trial and appellate courts, the Litigation Practice Group represents clients before federal and state administrative tribunals and regulatory agencies.
